LAWS ON RECORDING CONVERSATIONS IN ALL 50 STATES
Individuals, businesses, and the government often have a need to record telephone conversations that relate to their business, customers, or business dealings.
Laws governing telephone call recording are typically found within state criminal statutes and codes because most states frame call recording as eavesdropping, wiretapping, or as a type of intercepted communication. State laws may not explicitly mention telephone call recording because of these technical definitions. Accordingly, counsel may need to infer when and under what circumstances a state permits telephone call recording by reviewing prohibited actions.

Recording Conversations And Phone Calls - A Quick Primer
One-Party Consent
If the consent of one party is required, you can record a conversation if you’re a party to the conversation. If you’re not a party to the conversation, you can record a conversation or phone call provided one party consents to it after having full knowledge and notice that the conversation will be recorded...All-Party Consent
Twelve (12) states require the consent of everybody involved in a conversation or phone call before the conversation can be recorded. Those states are: California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington. These laws are sometimes referred to as “Two-Party” consent laws but, technically, require that all parties to a conversation must give consent before the conversation can be recorded.
Consent
What constitutes “consent” is also an issue of contention when you are considering recording a conversation. In some states, “consent” is given if the parties to the call are clearly notified that the conversation will be recorded, and they engage in the conversation anyway. Their consent is implied. For example, we have all experienced calling a customer service department only to hear a recorded voice warning, “This call may be recorded for quality assurance or training purposes.” It is usually a good practice for practitioners to let the witness know they are recording the call in order to accurately recall and commemorate the testimony being given – such as during the taking of a witness’ statement.
Exceptions
Nearly all states include an extensive list of exceptions to their consent requirements. Common exceptions found in a majority of states’ laws include recordings captured by police, court order, communication service providers, emergency services, etc...
Interstate/Multi-State Phone Calls
Telephone calls are routinely originated in one state and participated in by residents of another state. In conference call settings, multiple states (and even countries) could be participating in a telephone call which is subject to being recorded by one or more parties to the call. This presents some rather challenging legal scenarios when trying to evaluate whether a call may legally be recorded. A call from Pennsylvania to a person in New York involves the laws of both states. Which state’s laws apply and/or whether the law of each state must be adhered to are questions parties to a call are routinely faced with...
Federal Law
In most cases, both state and federal laws may apply. State laws are enforced by your local police department and the state’s attorney office. Federal wiretapping laws are enforced by the FBI and U.S. Attorney’s office. It is a federal crime to wiretap or to use a machine to capture the communications of others without court approval, unless one of the parties has given their prior consent. This means that if you are initiating a recording on a call that you are participating in, the other party does not need to be notified that the call is being recorded. Recording Calls Without Consent Still Illegal, California Supreme Court Rules
The court’s unanimous decision reverses the Fourth Appellate District’s opposite interpretation from 2019 that the law applies only to nonparties and does not forbid those on the call from recording each other without consent.
California’s penal code Section 632.7 makes it a crime to record or intercept a phone call “without the consent of all parties.”
This was the basis for a 2016 lawsuit by Jeremiah Smith, who claimed the loan provider LoanMe Inc. recorded him without his consent during an 18-second call in violation of Section 632.7. more

with our father without his knowledge. She says she does it because he
is so “funny,” i.e., eccentric, but I get the impression that she is
laughing more at him than with him. I find his conversations less
humorous than distressing, since he is often, at the best of times, in a
state of heightened psychological dysregulation and anxiety, and the
pandemic has just made things worse. Because of my sister’s behavior, my
niece has grown up thinking there’s nothing wrong or unethical with
recording conversations without the other person’s knowledge or consent
and has herself started to do this.

Jang Sung-Churl, chief executive of electronics firm Auto Jungbo Co. Ltd., told Reuters that covert recording devices “have been selling like hotcakes” …sales of voice recorders so far this year (2019) have doubled to 80 devices per day, Jang said as he forecast sales to also double this calendar year to 1.4 billion won ($1,172,289).Think about it. That's almost 30,000 devices sold per year... before the expected doubling of sales. And, he is only one manufacturer. An educated guess is that there are thousands of manufacturers around the world.

In-Person Recording Detection Tips
- Since frisking is probably out of the question, assume you are being recorded. Even if you could frisk, results would be iffy; these voice recorders are tiny.
- At the outset of a conversation ask the other person if they are recording you. Watch their reaction. Do they overly protest, or fake anger? If they say no but record anyway, the recording’s value can be challenged. They lied, so maybe they also faked, edited or doctored the recording.
- Also… Be professional. If you would not say it in a courtroom, don’t say it.
Covert Recording Detection Tips
- Pay attention to your surroundings. Who has access and when? Voice recorders need to be retrieved: to review recordings and to recharge batteries.
- Avoid using the same area for all your sensitive conversations. Use various and unpredictable locations if possible.
- Conducting your own search for surveillance devices is futile. An experienced eavesdropper will plant one easy-to-find device. They know the search will stop at that point. The harder-to-find device and it’s back-up will still be on the job. Without proper training and instrumentation your success is unlikely.
- For office and home office situations an independent Technical Surveillance Countermeasures (TSCM) sweep team should be employed. Have them conduct periodic due diligence debugging inspections. In addition to searching for room audio and video surveillance devices have them check your vehicles. Vehicle inspections also include a search for GPS tracking devices.

Sir Frederick Barclay's Nephew 'Caught with Bugging Device' at Ritz Hotel
Sir Frederick, 85, and his daughter Amanda are suing three of Sir David Barclay's sons for invasion of privacy.
They claim the surveillance gave the men commercial advantage and they sold the Ritz for half its market value.
The Barclay brothers' businesses include the Telegraph Media Group, the online retailer Very Group, the delivery business Yodel, and - at the time of the bugging - the Ritz hotel in London.
Sir Frederick, the elder twin by 10 minutes, and his daughter Amanda are suing Sir David Barclay's sons - Alistair, Aidan and Howard, Aidan's son Andrew, and Philip Peters, a board director of the Barclay group for invasion of privacy, breach of confidence and data protection laws.
The claim stems from a falling out between the children of the famously private twins...
The CCTV footage allegedly shows Alistair Barclay handling a bugging device at the Ritz hotel on 13 January this year. The recording shows Mr Barclay inserting a plug adaptor, which is claimed to contain a listening device, into a socket.
In court documents lodged by Sir Frederick and Amanda Barclay, it is claimed the bug - which was placed in the hotel's conservatory where Sir Frederick liked to conduct business meetings and smoke cigars - captured more than 1,000 separate conversations amounting to some 94 hours of recordings.
The pair claim the recordings amount to "commercial espionage on a vast scale"....

Second bug
It is also claimed a separate Wi-Fi bug was supplied by private investigation firm Quest Global. Its chairman is former Metropolitan Police commissioner Lord Stevens.
The claimants' documents say that Quest invoiced for 405 hours of listening and transcribing.
The recordings, it is alleged, captured "private, confidential, personal and Sir Frederick's privileged conversations with his lawyers, and with his daughter's trustees, bankers and businesspeople". more
Oddly, there is no mention of the video bug which recorded the incident. It does however make the nephew eligible for our Darwin Award for capturing himself with his own bug. ~Kevin
